Medical Law

Every year, Medical Law is highlighted due to the considerable increase of judicialization in the health area, in a broad way (medicine, dentistry, nursing, psychology, etc.). Aware of this scenario, the Barank Law Firm, in addition to its traditional legal practice in Civil Law and Consumer Law, sought specialization in the area of Medical Law, and currently, in addition to professionals with specific qualifications in the area, has experience due to its constant work in the area with more than 30 (thirty) clinics of various specialties. This experience has enabled the provision of specific legal services, among them:  

-Counseling and orientation regarding the rendering of medical services, mainly in the Risk Management, presenting measures of prevention and protection against eventual judicial demands. This is one instrument capable of reducing the dissatisfaction of patients, by means of effective control of calculable risks;

-Elaboration of Service Rendering Contracts and Informed Consent Terms, aiming, especially, at the prevention of future demands and a better grounding later on in supervening administrative and judicial demands;

-Elaboration of defense in ethical-professional processes (inquiries, complaints) before the professional representative councils, such as the Regional Council of Medicine, Regional Council of Dentistry, and Regional Council of Nursing, for cases related to the medical activity itself in the rendering of services, or in cases of non-compliance by the professional of administrative issues inherent to his profession;

-Elaboration of defenses in actions for medical error, acting in the civil and criminal areas, promoting the defense of health professionals in a qualified manner;

-Proposal of related actions, in face of health plans, health insurances, “SUS” (Unified Health System), etc, both in defense of the interests of health professionals and the population served by these services.

-Tax planning and analysis for tax optimization of clinics and health professionals.
